Legal Aid is a source of public funding, administered by the Legal Services Commission, available to qualifying individuals to assist with the resolution of medical negligence compensation claims. Medical negligence legal aid is means tested and whilst most adults do not qualify unless they are on DSS benefits, almost all minors, unless they are in paid employment, do qualify. Children typically almost always qualify for full legal aid with no financial contribution. A child can qualify for medical negligence legal aid despite having parents with substantial assets and income as it is the child’s income and assets that are relevant and not the parents.

In order to qualify for medical negligence legal aid, a claimant must satisfy the criteria and financial parameters of the Legal Services Commission :-

• Cost Benefit There must be a reasonable relationship between the cost of the legal action and the anticipated compensation if the claim is won.

• Success Prospects The applicant must have a better than 50% chance of winning their clinical negligence case. Note, however, that there are some exceptions to this general rule, particularly where the case is of critical importance to the applicant.

• Case Importance The importance of a case is judged according to the importance the claim would have to a reasonable person under the same circumstances. Factors considered in making this determination include the amount of compensation at stake and the consequences the applicant would face if they failed to take legal action.

No Win No Fee

If you do not qualify for public funding, a solicitor may take your case on the basis of a no win no fee agreement whereby your solicitor only receives their legal fees if they win your case. Simply put, your solicitor only gets paid if you do. Note that the claimant may have to provide some financial contributions to fund the claim as it proceeds.

Private Funding

Privately funded cases are far less common since the advent of the no win no fee payment scheme. The option, however, still exists. A claimant can choose to fund the claim themselves if their solicitor is not willingly to take the risk of pursuing the claim on a no win no fee basis. Protection for the claimant exists in the form of insurance that can be taken out to cover the risk of losing the case and being ordered by the court to pay the defendant’s legal costs.
